GENERAL TERMS AND CONDITIONS

Please read carefully through the following General Terms and Conditions as they are an important component of your booking with Photography Adventures.

§1. General Terms and Conditions (hereafter mentioned as "GTC")

§1.1 The signing parties

These GTC shall regulate the legal relationship between The Customer (hereafter mentioned as "you") and Photography Adventures (hereafter, “PA") from the moment of its acceptance by you at the end of the booking procedure and for the duration of the booked photography workshop(s) as well as the intensive course offered prior to the trips organised by PA or other services offered by PA in its own name.

§1.2 Applicability of the GTC

These GTC are only valid for bookings made through this site https://www.photoadventures.ch/booking-iceland-photography-workshop-2022
The updated date is always applied to the GTC should they be updated or changed.

§1.3 Internet Site, Offers, Early bird discounts Etc.

The information given on the website or other promotional material through flyers, social media and other means, can be changed at any time without prior notice. The exact information published on the website (www.photoadventures.ch) at the time of your booking and acceptance of these GTC will always prevail.

§1.4 The GTC can be changed at any time and without prior notice. The date of the GTC which is clearly stated at the bottom is always the decisive point as to the final version at any given time. The most up to date version of the GTC always replaces any previous GTC.

§2. Prices and Payment Terms and Conditions

§2.1 Prices

The prices for the workshop(s) is/are always clearly and transparently stated in the "Dates/Prices" section of the "Tour Information" page on the website for the specific photography workshop. If nothing to the contrary is mentioned in the "Dates/Prices" section, the prices are stated in Swiss francs (or EURO or $ USD) per person for the complete duration of the workshop. Regular accommodation is usually in a double room, unless the booked stay by the organiser contains separate room per person. The services included in the total price are clearly and transparently stated in the "Included" section on the "Tour Information" page of the website. The payment can be made in Euros or in USD if you find it more convenient. In this case please contact PA prior to initiating a transfer as the amount in Euros or USD will be determined based on that day's currency exchange rate between the Swiss Franc and Euro or USD.

§2.2 Deposit payment

The required deposit is always clearly and transparently stated in the "Dates/Prices" section of the "Tour Information" page for the specific photography workshop on this website. The deposit is to be paid within 5 working days after your official booking and the agreement to these GTC. Should the deposit not arrive within the given time frame, PA reserves the right to cancel the booking and to open the space once again for the general public. A brief margin for human error will be given during which you can initiate the payment or contact PA to give further information as to the reason for the delay.

§2.3 Remaining Payment

The remaining fee due is to be paid in accordance with the information clearly and transparently stated in the "Deadlines / Cancellation" section of the "Tour Information" page. If the payment is not received within the stated time frame, PA may deem your participation void and open the space to another interested party. A brief margin for human error will be given during which the customer can contact PA to give further information as to the reason for the delay.

§2.4 Short notice bookings

If you book your trip less than 30 days before departure, the entire amount shall be paid immediately after these GTC have been accepted and the booking procedure has been completed.

§3. Changes to your registration, Cancellation costs, Cancellation reasons

§3.1 General

The changes to your registration - If you need to update / change the original registration data, please let PA know as soon as possible by means of an Email. Cancellation conditions are clearly stated in the “Cancellation” section of the “Tour Information” page.

§3.2 Cancellation Costs

Cancellation conditions are clearly stated in the “Cancellation” section of the “Tour Information” page. They are as follows:

Cancellation up to 4 weeks (8.1.2022) before the start of the workshop - 95% refund of the total amount. Cancellation 2 to 4 weeks (8.1.2022 – 22.1.2022) prior to workshop start date - 50% refund of total amount.

Cancellation 2 weeks or less before workshop start date (from 22.1.2022) - no refund.

§3.3 Cancellation costs due to visa denial, invalid travel documents, flight cancellation

§3.3.1 Should you require an entry visa it is your responsibility to apply for it in a timely matter. Should it be determined that your visa application was delayed beyond reasonable time frame due to a late application from your side, and as a result you must cancel your participation in the workshop, no refund will be offered. In any other case, regular Cancellation Costs as per §3.2 apply.

§3.3.2 If you do not possess, forget or lose your travel documents and as a result you must cancel your participation in the workshop, no refunds will be offered. In any other case, regular Cancellation Costs as per §3.2 apply.

§3.3.3 If your flight or connecting flight is to be cancelled and as the result of such you are going to miss the beginning of the workshop, no refund can be offered as such. PA will however do everything possible to readjust its daily schedule to make it possible for you to join during the day or coming days.

§3.4 Force Majeure, Strikes

In the event of force majeure, political unrest, strikes, catastrophes, etc., the trip may be cancelled by PA on short notice owing to safety concerns. In this case, you shall receive a reimbursement of the amount that you have paid. Any more extensive damage compensation claims shall be excluded.

§3.5 Miscellaneous Reasons

PA shall be entitled to cancel a trip or an event owing to other reasons. If this is the case, you will be notified as soon as possible.

Regular Cancellations shall be valid only if they have been sent to PA by email or in writing via registered letter if you prefer. The deciding date is the date when the email has been sent or the date on the postal office receipt within the times stated in §3.2. The email and / or the postal address of PA is clearly stated in the Footer section at the bottom of the website as well as at the bottom of these GTC.

§4. Entry, Visa and Health Directives

§4.1 During the booking you will be asked to disclose your nationality. This is in order for PA to be able to advise you whether or not you are required to obtain an entry visa to the country where the Photography Workshop will be taking place.

§4.2 If travel documents must be issued or renewed or a visa must be obtained, you yourself shall be responsible for obtaining them. If a travel document will be received or is issued too late due to late initiating of the process by you, and you must cancel the trip, the cancellation terms and conditions shall be valid.

§4.3 The travelers themselves shall be responsible for entry, health, customs and foreign currency directives. Before your departure, please ensure that you have all required documents in your possession.

§4.4 PA wishes to point out to you that you must pay the return trip costs in the event that you are refused entry into the respective country being visited. PA expressly wishes to likewise point out to you the legal consequences of bringing banned goods into the respective country being visited.

§5. Participation program, General program, Daily program and Personal behavior conduct

§5.1 Travel Information

The procedure of the "Meet & Greet" as well as the "Departure" is clearly written under the "Daily Schedule and Highlights" section of the Tour description. "Meet & Greet" - Day 1, "Departure" - Day 10.

§5.2 Daily program

The exact daily schedule will always be decided a day in advance and based on the weather prognosis. The photography of the "Aurora Borealis" phenomenon will be offered as much as the weather conditions as well as Sun activity will permit us to do so. "Sunset / Sunrise" photography will be offered based on the combination of the weather conditions and the suitable location.

§5.3 Participation Terms

You are completely free to decide to stay indoors at the accommodation should you prefer to do so. The participation in all the activities is always encouraged and is always welcome but is not obligatory. It is up to you to take part in all or just in some of these photography activities.

§5.4 Conditions

Please note that due to the distances between the accommodation and the photography locations the travel time by car towards them can sometimes be up to 45 minutes or 1 hour or 1-2 hours walking distance. Your decision to stay indoors cannot be changed once the other participants and PA are on the way, out of respect towards the other participants of the Workshop and due to daily light times.

§5.5 Personal behavior conduct

PA is all about Photography between likeminded people and is open to all races, sexes, levels. Under no circumstances will PA tolerate any behavior that is disrespectful, discriminating, racist or sexist towards other participants. PA reserves the right to cancel your participation during the workshop if such an event occurs. In this case, the return journey to Reykjavik and onwards will be your responsibility and no refund will be offered.

§6. Damages, Loss, Insurances and Safety

§6.1 Valuables, Cash, Jewelry, Credit Cards, Etc.

You shall be responsible for the secure safekeeping of valuables, cash, jewelry, credit cards, photographic, video and communications equipment, etc. PA shall not be liable in the event of the theft, loss, damage or misuse of credit cards or if these should go missing as well as the theft of cash, etc.

§6.2 Personal Injury, Accidents and Illnesses

PA can/will not be liable for personal injury, death, physical injury or illness during the trip unless this has been caused by PA. In example: improper driving by the PA guide which results in an accident. Not giving warning instructions in photography locations should any danger present itself.

§6.3 Property Damage and Financial Losses

You, the participant, shall be held responsible for any damage to the property (Hotel rooms, Apartments or Houses, Car rentals) in which we are going to be staying or in case of the car rental - driving. Please let PA guide know straight away in case of any damage (intentional or unintentional).

§6.4 PA is not responsible for damages or loss of your belongings and/or equipment due to erroneous usage or storage of such.

§6.5 Health, Travel and Equipment insurance is your responsibility.

§6.6 Drone pilots are strongly advised to obtain an international insurance for themselves in case of any inflight/post flight damages. PA is not responsible and can/will not be liable for any damage caused due to drone error or pilot's error.

§6.7 PA guide will always warn you of any dangers in the area due to weather and/or raw nature of the country you are visiting. Please obey these warnings and act accordingly. PA is not responsible and can/will not be liable for any damage caused due to not following the warnings of the PA guide.

§7. Liability of PA

§7.1 General

PA is liable to fulfil its obligations towards you, which are described under “Included” section of the “Tour Information” section and to offer you the following services during the photography workshop:

  • Intensive pre-trip photography course (via Facetime/Whatsapp Video call or meeting in Zurich/Zug/Luzern) Intensive photography guidance during the whole trip.

  • Post-processing guidance / suggestions / help

  • 10 days and 9 nights accommodation in double rooms with breakfast.

  • Travel in a spacious 4x4 Jeep including pickup from and return to Keflavik airport (Please refer to Dates/Prices tabs for arrival/departure times suggestions).

  • Complimentary 4G/3G Wi-Fi throughout the trip (Mobile Hotspot reception depending on the network coverage)

  • 1x Entrance to Myvatn Nature Baths (weather permitting)

§7.2 Liability Restrictions, Liability Exclusions

PA shall not and cannot be liable for events which are out of PA's control and which might influence the daily program or other events. In example: Roads closure due to weather or other reasons, Accidents which occur due to a fault of other drivers.

§8. Data Protection

The protection of your private sphere and your personal data are of utmost importance to PA. PA's data protection directives are in compliance with the valid data protection directives. The personal data that you provide to PA shall be processed and used electronically as long as they are required for the implementation of the GTC or for optimal customer support. You hereby acknowledge that your information might be used by PA while booking accommodation in the country of the photography workshop and only in the case where the local authorities are requiring PA to supply such information. Under no circumstances will your private data and information be sold, sent or given to any other third- party entity for commercial gain of PA

§9. Ombudsman

Before commencing legal proceedings, you should seek redress with the independent ombudsman of the Swiss travel industry. The ombudsman shall endeavor to obtain a fair, well-balanced agreement for any type of problem.

§10. Applicable Law and Legal Venue

Exclusively Swiss law shall be valid for the legal relationship between you and Photography Adventures. The exclusive legal venue shall be City of Zug.
